If you decide a claim is necessary you, or your partner, will be required to act as your child's 'litigation friend'. As your child will be under 18, and therefore a minor, they cannot bring a claim in their own name and will need their mum or dad to bring the claim on their behalf. The role of a litigation friend is to fairly and competently conduct the proceedings of the claim on behalf of the minor. This simply means that every decision you make regarding the claim must be made in your child's best interests.
